Learner Agreement & Standard Terms and Conditions of Enrollment
Welcome to Wharton Sustainable Solutions.
By enrolling in any training programme offered by Wharton Sustainable Solutions, including but not limited to IOSH, OSHA, NVQ, ISEP, professional development courses, eLearning programmes, classroom training, or virtual learning programmes, you agree to comply with the following Learner Agreement and Standard Terms and Conditions.

1. Our Commitment
Wharton Sustainable Solutions will:
• Deliver training through competent, qualified, and experienced trainers.
• Provide appropriate learning resources, guidance, and learner support.
• Maintain a professional, respectful, and learner-focused training environment.
• Support learners with revision guidance, assessment preparation, and examination techniques where applicable.
• Review formative assessments and provide feedback within a reasonable timeframe.
• Conduct training in accordance with the requirements of the relevant awarding body, certification body, or programme approval body where applicable.
• Treat all learners fairly, professionally, and without discrimination.

2. Learner Responsibilities
The learner agrees to:
• Attend the selected training programme as scheduled.
• Maintain a minimum of 80% attendance for live online or classroom-based courses.
• Complete at least 80% of assigned eLearning activities for self-paced programmes.
• Complete all required formative assessments, assignments, practical activities, and mock examinations where applicable.
• Participate actively in learning activities and maintain professional behaviour throughout the programme.
• Inform the trainer or learning advisor promptly if any learning difficulties or special support requirements arise.
• Follow all instructions issued by Wharton Sustainable Solutions relating to training, assessments, examinations, certification, and learner conduct.

3. Academic Integrity and Professional Conduct
The learner understands and agrees that:
• All coursework, assignments, assessments, examinations, and practical activities must be completed by the registered learner.
• Plagiarism, impersonation, cheating, collusion, falsification of records, use of unauthorized materials, or any other form of academic misconduct is strictly prohibited.
• Any breach of academic integrity may result in disciplinary action, suspension, cancellation of enrollment, withholding of certification, or reporting to the relevant awarding body.
• Wharton Sustainable Solutions maintains a zero-tolerance approach towards academic misconduct and unethical practices.
• Enrollment in a course does not guarantee examination success, certification, professional membership, employment, promotion, or any specific career outcome.

4. Attendance and Eligibility Requirements
The learner understands that:
• Attendance and participation requirements must be met before progressing to final assessment, examination, or certification stages where applicable.
• Failure to meet attendance requirements may affect examination eligibility or certification processing.
• Failure to complete required learning activities, assignments, assessments, or practical exercises may delay progression or certification.
• Learners who discontinue, withdraw, or fail to attend may be required to rebook a future batch subject to seat availability and applicable charges.
• Final eligibility remains subject to the requirements of the relevant awarding or certification body.

5. Fees and Payment Terms
The learner agrees that:
• Course fees, examination fees, assessment fees, certification fees, and administrative charges may be charged separately depending on the programme.
• All fees must be paid within the approved payment period.
• Examination or certification fees must be paid before the applicable registration or submission deadline.
• Access to course materials, eLearning platforms, examination registration, assessment submission, learner portals, certificates, transcripts, or other services may be withheld until all outstanding payments are fully settled.
• Wharton Sustainable Solutions reserves the right to suspend services where payments remain overdue.
• Fees are subject to revision where necessary due to changes in awarding body charges, certification fees, taxes, administrative costs, or operational requirements.

6. Ethical Conduct, Admissions and Examination Integrity
The learner acknowledges and agrees that:
• Wharton Sustainable Solutions does not normally recruit learners through third-party agents, brokers, or commission-based representatives unless formally authorised by the company.
• If a learner has been referred by an agent, consultant, representative, or third party, the learner must disclose this information during admission or enrollment.
• Failure to disclose the involvement of a third-party representative may affect admission, registration, or eligibility for certain services.
• Wharton Sustainable Solutions does not provide, advertise, or imply any form of pass guarantee, examination guarantee, certification guarantee, or guaranteed employment outcome.
• All examination results, assessment decisions, and certification outcomes depend solely on learner performance and awarding body requirements.
• Wharton Sustainable Solutions, its trainers, employees, contractors, and representatives will not provide examination answers, assessment solutions, unauthorized assistance, or any form of examination support that breaches awarding body requirements.
• Any learner approached by a staff member, trainer, representative, or third party offering examination assistance, guaranteed results, certification support, or preferential treatment in exchange for money or other benefits must immediately report the matter to:

• Wharton Sustainable Solutions maintains a zero-tolerance policy towards bribery, corruption, cheating, plagiarism, impersonation, falsification of records, and all forms of academic or professional misconduct.
• Any learner or employee found to be involved in such activities may be subject to disciplinary action, cancellation of enrollment, reporting to the relevant authorities, and any action permitted by law.

7. Course Delivery
Wharton Sustainable Solutions reserves the right to:
• Allocate one or more trainers to deliver a programme.
• Determine class sizes based on operational and academic requirements.
• Deliver training through classroom, virtual, blended, workplace, or self-study methods as appropriate.
• Update learning materials and course content to improve quality, accuracy, relevance, or learner experience.
• Correct minor errors or omissions identified in training materials.

8. Course Changes and Cancellations
The learner understands that:
• Course dates, schedules, trainers, venues, delivery methods, or programme arrangements may be changed where necessary.
• If Wharton Sustainable Solutions cancels a programme, learners will normally be offered a transfer to the next available suitable batch.
• Wharton Sustainable Solutions shall not be liable for delays, interruptions, or cancellations caused by circumstances beyond its reasonable control.
• Such circumstances may include technical failures, public emergencies, natural disasters, government restrictions, internet disruptions, industrial action, or other unforeseen events.
• Reasonable efforts will be made to support affected learners and provide an appropriate alternative arrangement where possible.

9. Examinations, Assessments and Certification
The learner understands that:
• Examination, assessment, and certification registrations are confirmed only after payment and eligibility requirements have been satisfied.
• Examination registration deadlines established by awarding bodies must be followed.
• Final examination results, assessment decisions, malpractice decisions, certification decisions, and membership decisions remain solely under the authority of the relevant awarding or certification body.
• Wharton Sustainable Solutions cannot alter, influence, or override official decisions made by awarding bodies.
• Certification processing may be subject to awarding body processing timelines and learner compliance with all programme requirements.

10. Complaints and Grievances
If a learner has a concern:
• The matter should first be discussed with the trainer or learning advisor.
• If the matter is not resolved informally, a formal complaint may be submitted by email.

• Wharton Sustainable Solutions will investigate complaints fairly and respond within a reasonable timeframe.
• Matters relating to official examination results, academic standing, malpractice investigations, certification decisions, or professional membership decisions may need to be addressed directly through the relevant awarding body’s procedures.

11. Data Privacy and Information Sharing
The learner understands and agrees that:
• Personal information may be collected for admission, learner administration, examination registration, assessment processing, certification, quality assurance, and learner support.
• Required learner information may be shared with awarding bodies, certification bodies, regulators, auditors, training partners, accreditation organisations, or administrative service providers where necessary.
• Information shared may include learner name, contact details, identification records, attendance records, assessment records, examination records, and certification information.
• Personal data will only be used for legitimate educational, certification, quality assurance, compliance, and administrative purposes.
• Wharton Sustainable Solutions will take reasonable measures to protect personal information and maintain confidentiality.
• Personal data will not be sold to third parties.

12. Governing Law and Jurisdiction
The learner understands and agrees that:
• These Learner Agreement and Standard Terms and Conditions shall be governed by and interpreted in accordance with the laws of India.
• Any dispute, claim, or legal proceeding arising out of or relating to enrollment, training services, assessments, certification, payments, refunds, or these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts at Kolkata, West Bengal, India.
• The learner agrees that the courts at Kolkata shall have exclusive jurisdiction to hear and determine any such dispute or claim.
• Matters relating to examination results, malpractice investigations, certification decisions, or professional membership decisions shall first be addressed through the procedures established by the relevant awarding or certification body before legal proceedings are initiated.
